Tainted Tissue and Bones Used in Transplants
HIV AND HEPATITIS FROM "HIGH RISK" ORGAN DONOR
In January 2007, four individuals were informed that they were infected with HIV and Hepatitis after organ transplants at three Chicago hospitals - Northwestern Memorial Hospital, Rush University Medical Center and the University of Chicago Medical Center.
The organ transplant system is not 100% safe. In this particular situation, according to Gift of Hope, the donor that was tested for infectious diseases was found negative. However, if the testing is done during a window period within three weeks of acquiring the infectious disease, the results can come back negative, a false negative.
It is extremely important that the donor criteria and screening process for infectious diseases be strictly followed to minimize the risk of disease transmission to recipients of donor organs, tissues and bones. Furthermore, recipients have a right to know if the donor is "high risk" prior to agreeing to a transplant.
Motley Rice LLC is currently representing approximately 570 recipients of stolen bone and tissue that were implanted during surgery. These bones/ tissues were all recalled after the FDA discovered that the bones and tissues were not actually donated but rather a portion were stolen from individuals that died due to infectious diseases and cancer and would have not have been donor eligible. Motley Rice also currently represents 27 families whose love ones' body parts were stolen without consent in conjunction with the same litigation and we have been working closely with national experts regarding not only transmission of disease by organs, tissue and bones but also the proper testing and screening protocols that must be followed.
Motley Rice LLC is one of the nation's largest plaintiffs' litigation firms. Motley Rice still embraces the conviction that, undaunted by intimidating corporate opposition, attorneys can force changes that protect the public and make the world a safer place.
