Asbestos Manufacturer Liable: Jury awards $9.3 million
On June 20, 2014, a federal court jury in Massachusetts found T&N Ltd., the manufacturer of an asbestos-containing spray fireproofing liable. The jury returned a $9.3 million verdict against T&N Ltd., including $6.2 million in punitive damages.
Motley Rice represented the Federal-Mogul Asbestos Personal Injury Trust, which brought the suit on behalf of Katherine Lydon and her late husband, John. A pipefitters’ union manager, John visited the construction site of Boston’s Prudential Tower in the 1960s and was allegedly exposed to the asbestos-containing spray insulation called Limpet. He lost his battle with mesothelioma in 2010.
The Trust, established as part of the bankruptcy plan for automotive products manufacturer Federal-Mogul, brings suits such as these in an effort to compensate claimants suffering from asbestos-related injuries.
“The jury’s resounding message in this verdict should offer some hope for victims of asbestos exposure,” stated asbestos attorney John Herrick of Motley Rice LLC who represented Lydon. “While Mr. Lydon was not able to see this trial through to the end, his family’s perseverance has paid off and hopefully offers strength to other victims and their families still battling for justice.”
