Defining Meningitis Suits: Motley Rice attorneys discuss potential lawsuits with Reuters
As of Oct. 24, 2012, more than 300 people have been infected with fungal meningitis, and another 23 are dead after receiving the allegedly tainted steroid shots produced and distributed by the Massachusetts-based New England Compounding Center (NECC).
Reuters reports that many are considering or already pursuing litigation and that the main emerging question is one of accountability, whether "the injections are subject to product liability or medical practice laws." In the article, Motley Rice attorneys Don Migliori and Fred Thompson discuss the potential lawsuits involving these injections.
"The question will be whether the doctor or the hospital failed to investigate the competence and safety of the steroids, and you'll have to put some flesh on those bones," said Thompson. Migliori stated that Motley Rice represents meningitis victims who plan to sue NECC within the next several days but added that the suits may expand over time to include other defendants.
