SG Opinion Sought: Supreme Court asks government’s view in burn pit litigation

The U.S. Supreme Court is seeking the opinion of the solicitor general in the burn pit litigation, KBR Inc. et al. v. Alan Metzgar et al, pending with the Supreme Court. The multidistrict litigation addresses wrongful death and personal injury claims of veterans against the military contractor KBR, Inc. for its management and operation of open-air burn pits in active war zones.

While a district court dismissed the litigation in February 2013, the Fourth Circuit revived the case a month later, prompting KBR to petition the U.S. Supreme Court for review.
