Burn Pit Update: Ruling by Federal Appeals Court allows burn pit cases to proceed
On March 6, 2014, the United States Fourth Circuit Court of Appeals overturned the district court’s dismissal of hundreds of soldier’s claims against KBR and held that the claims in In re KBR Inc. Burn Pit Litigation may now proceed and have been remanded to U.S. District Court for the District of Maryland for further proceedings.
“The suffering that many veterans are living with now due to their service in Iraq and Afghanistan is deplorable and upsetting,” stated James Ledlie Motley Rice lawyer and one of the attorneys for burn pit victims. “This ruling affords the opportunity to have the true facts concerning burns pits in Iraq and Afghanistan brought to light.”
Motley Rice attorneys have been working with co-counsel Susan Burke of Burke PLLC in the KBR, Inc., Burn Pit multidistrict litigation (MDL) representing clients against multiple defense contractors for allegedly exposing American soldiers and former employees of defense contractors to toxic smoke, ash and fumes generated by disposing of waste in open-air burn pits in Iraq and Afghanistan.
