DePuy Pinnacle MDL: Hip replacement lawyer named to PSC

The Honorable James Ed Kinkeade appointed Motley Rice member and hip replacement lawyer Don Migliori to the Plaintiffs' Steering Committee (PSC) for the DePuy® Pinnacle® multidistrict litigation, In re Depuy Orthopaedics, Inc. Pinnacle Hip Implant Products Liability Litigation.

Hundreds of cases are currently pending in the MDL against Johnson & Johnson subsidiary DePuy Orthopaedics and allege that the device's metal-on-metal hip design is forcing patients to undergo corrective surgery or have the prosthetic removed within the first five years of their initial implant. The design of the Pinnacle hip replacement is similar to that of the DePuy ASR™ XL Acetubular Hip Replacement System, which was recalled in August 2010 due to a high rate of premature failures.

An MDL consists of numerous pending civil cases of a similar nature filed against a common defendant and transferred to one federal judge to be handled. The central role of the appointed PSC is to coordinate the numerous lawsuits in the MDL and represent the plaintiffs. The DePuy Pinnacle lawsuits were consolidated and centralized in the U.S. District Court for the Northern District of Texas on May 23, 2011.

Migliori also serves on the PSC for the DePuy ASR XL Acetabular Hip Replacement System MDL.
