Hernia Patch Lawsuits: Kugel trials scheduled for 2011

The next two trials in the federal Composix® Kugel® Mesh hernia patch MDL have been scheduled to begin in late April 2011 and July 2011 in the U.S. District Court for the District of Rhode Island before Chief Judge Mary M. Lisi. The cases are the third and fourth cases selected for the early bellwether trials out of the thousands filed against hernia patch manufacturer Davol and parent company C.R. Bard.

The jury for the first bellwether case, John Whitfield v. Davol, Inc., et al., found in April 2010 that the hernia repair patch was negligently designed, but also found that the negligently designed product did not cause the plaintiff's alleged injuries, resulting in a defense verdict. In August 2010, the jury awarded the plaintiffs in the second bellwether case, Christopher Thorpe and Laure Thorpe v. Davol, Inc. and C.R. Bard Inc., a total of $1.5 million, finding that Davol and C.R. Bard acted unreasonably in designing the patch.

There are also hundreds of additional hernia patch cases that have been centralized in Rhode Island state court, the first having settled in October 2010 for a confidential amount prior to trial. The next two trials have been scheduled to begin in February and Spring of 2011 in Rhode Island Superior Court before Presiding Justice Alice B. Gibney.
