Rhode Island jury awards $4.8 million verdict to man injured by Bard hernia mesh

Medical device manufacturer C.R. Bard is liable for severe gastrointestinal injuries a Hawaii man developed after receiving the company’s Ventralex™ mesh in a hernia repair. Motley Rice LLC, one of the nation’s largest plaintiffs’ litigation firms, represented plaintiff Paul Trevino in the month-long jury trial, obtaining $4.8 million in compensatory damages for negligence five days after closing arguments were heard in Rhode Island Superior Court.

“I couldn’t be any happier for the Trevino family. They sat through a lot. In the end, the jury saw through the blame game and ruled in favor of justice,” said Motley Rice medical device attorney Jonathan Orent, who represented Trevino.

Attorneys Christina Behm, Grace Chandler, Dennis Costigan, Annie Kouba, Laura Stemkowski and Hank Young from Motley Rice joined Orent on the trial team as did Katherine Charonko, Brian McAlister and Elizabeth Stryker from Bailey Glasser LLP.

Trevino alleged that Bard made his hernia mesh device using a low-quality polypropylene plastic that was not safe for use in humans. Trevino suffered severe complications and corrective surgeries after the mesh burrowed into his intestinal tissue over the course of several years.

“Thank you to the lawyers and staff who took time out of their lives and away from their families for this case. Justice was served,” said plaintiff Paul Trevino.

Orent is co-lead counsel, liaison counsel and a member of the Plaintiffs’ Steering Committee for In re Davol/ C.R. Bard Hernia Mesh, in addition to being lead counsel for In re Atrium Medical Corp. C-QUR Mesh Products Liability Litigation.
