Within recent weeks, three Motley Rice medical device and drug lawyers have been appointed by federal judges to serve on Plaintiffs’ Steering Committees in national multidistrict litigations (MDL). Attorneys appointed to these positions are charged with representing the common interest of all the plaintiffs within an MDL. Being selected to a leadership position within an MDL is part of a formal process in which, most often, plaintiffs’ attorneys with related cases submit to be considered based on their experience and other considerations. The judge assigned to the MDL then considers various factors when deciding the leadership and committee members. 

Motley Rice attorney Carmen Scott is part of a historic group, being appointed to the Plaintiffs’ Steering Committee for the Laparoscopic Power Morcellation litigation. The National Law Journal reported on the creation of the MDL for the morcellation litigation, calling it the first PSC with a majority of female members. 

Kimberly Barone Baden, also a Motley Rice medical drug attorney, was named co-lead counsel in the Zofran® birth defect MDL. Reuters reported on the appointment, calling those appointed to the panel, “pharmaceutical mass-tort veterans.”

Motley Rice lawyer Don Migliori was appointed to serve on the Plaintiffs’ Steering Committee for the IVC Filter litigation. Don has litigated against Bard, the primary defendant in this litigation, in previous litigation and cases, including those involving Kugel Mesh and transvaginal mesh.
