Tens of thousands of plaintiffs who allege Johnson and Johnson’s talc-based products, including J&J’s Baby Powder, caused ovarian cancer have resolved their claims through a settlement valued at a minimum of $5.5 billion.The announcement follows more than a decade of litigation and several unsuccessful attempts by Johnson & Johnson to resolve the claims through bankruptcy proceedings. Plaintiffs have alleged that the company’s talc products caused ovarian cancer.Motley Rice attorney Carmen Scott, a member of the Plaintiffs’ Steering Committee in the federal multidistrict litigation, said the proposed resolution reflects years of work on behalf of women and families seeking accountability.“For many women and families, this litigation has been a long and difficult journey. While no settlement can undo the harm alleged in these cases, this proposed agreement represents meaningful progress toward providing compensation and certainty for thousands of claimants who have waited years for resolution,” Scott said.Dan Lapinski, also a member of the Plaintiffs’ Steering Committee and litigator with Motley Rice, emphasized that the settlement is intended to provide eligible claimants with a path forward.“The settlement is designed to provide all eligible claimants with an avenue to resolve their pending claims. Under the terms of the settlement, compensation is awarded through a transparent, tiered system that provides each claimant the opportunity to evaluate the value of her claim and make decisions based upon objective criteria,” Lapinski added.
