Motley Rice LLC, one of the nation’s largest plaintiffs’ litigation firms, filed a federal lawsuit today against Delta Air Lines, Inc., and its subsidiary Endeavor Air. The suit was filed over the crash of Delta Flight 4819 at Toronto Pearson International Airport on February 17, 2025. The flight from Minneapolis to Toronto overturned immediately after it landed. Several passengers were injured, including the plaintiff, Minneapolis resident Hannah Krebs.

The lawsuit alleges negligence because the Delta and Endeavor Air flight crew did not use standard landing procedures. The suit also claims inadequate training and supervision contributed to the crash. The lawsuit was filed in the U.S. District Court for the District of Minnesota, Minneapolis Division, seeking compensation in accordance with international aviation law (the Montreal Convention).

“As a former U.S. Air Force navigator, I understand the challenges that flight crews often face in the moment, but adhering to established protocols is critically important to ensure passenger safety,” said Motley Rice aviation attorney Jim Brauchle, who represents Ms. Krebs. “This suit seeks to hold Delta and Endeavor Air accountable for actions we believe led to a preventable catastrophic event.”

More than 80 people were aboard the Delta flight. When the plane flipped upon landing, the passengers were thrown upside down as well. Ms. Krebs’ lawsuit seeks compensation to cover damages for physical and emotional injuries and damage to her property aboard the plane.

The Transportation Safety Board of Canada is investigating the cause of the crash.
