Lyft Sexual Assault Lawsuit

A Lyft sexual assault involves non-consensual sexual behavior occurring between a Lyft driver and a passenger. This behavior may include non-physical sexual harassment and misconduct, unwanted physical contact and sexual violence. This may include:

• Rape or oral penetration
• Non-consensual touching, feeling, kissing or genital exposure
• Being driven off route, combined with threats, intimidation or coercion
• Aggressive flirtation and threats

Passengers of any age or gender can experience a Lyft sexual assault. 

The potential risks of using rideshare apps

Ridesharing apps, like Lyft and Uber, connect riders with nearby drivers via smartphones. Almost anyone can get approved to drive for the Lyft platform if the company verifies that the drivers have a valid driver’s license, pass a criminal background check and have a clean driving history. They must also have auto insurance and a registered vehicle.

This model has inherent risks. Drivers and riders are strangers who agree to being alone and in a confined space with someone they don’t know. Riders who are picked up at their homes entrust their home address to their driver. Riders are also entrusting drivers to transport them where they need to go and not to any other location. 

Lyft tracks reported safety incidents involving its drivers and incidents brought to the company’s attention by law enforcement, the media or social media. According to Lyft’s Safety Transparency Report, from 2020 to 2022, there were 2,651 instances of the five most serious categories of sexual assault. These include:

1. Non-consensual sexual penetration (rape)
2. Attempted non-consensual sexual penetration
3. Non-consensual kissing of a sexual body part
4. Non-consensual touching of a sexual body part
5. Non-consensual kissing of a non-sexual body part

Instances of rideshare sexual assaults involving Uber drivers have also been documented. The New York Times reported that from 2017 to 2022, Uber received a report of sexual assault or sexual misconduct almost every eight minutes.

• Report the incident to Lyft: Report instances of sexual assault or harassment through the Lyft app or by phone. Lyft operates a round-the-clock Safety team that’ll call you back as soon as possible after you request a call. On its website, Lyft states that it “will conduct an impartial and timely investigation to reach reasonable conclusions based on the information collected.” 
• Report the incident to someone you trust: Report the Lyft sexual assault to a family member, friend or mental health professional. Telling gets you the support you need and helps you validate the incident if you decide to pursue a Lyft driver lawsuit. You should also inform the police. Formally reporting to law enforcement and making an official report on the Lyft app will generate necessary evidence for any legal action you decide to take. 
• Save proof of your ride: Don’t delete the Lyft app or remove your account from the platform. Lyft maintains a detailed overview of your trips since 2014 under the “Ride history” tab. This ride history can’t be forged or faked by AI, unlike screenshots and ride receipts.

Note that Lyft sexual assault allegations can also give rise to criminal charges. In a criminal case, the government brings legal action against those accused. The intent of a criminal case is to punish wrongdoers via fines, jail time, probation and other measures.  

Plaintiffs bring civil actions. Civil cases seek monetary compensation for victims for the harm they have suffered.

On February 2, 2026, the Judicial Panel on Multidistrict Litigation consolidated multiple assault claims against Lyft drivers into a mass tort lawsuit in the Northern District of California. This case is called In re: Lyft, Inc. Passenger Sexual Assault Litigation, MDL 3171.

The Lyft sexual assault lawsuits claim that the rideshare company knew about the risk of sexual assault, but didn’t implement appropriate safety precautions to protect the app’s users. The plaintiffs allege that Lyft failed to:

• Adequately train and supervise drivers
• Adopt standard safety measures, such as mandatory video or audio surveillance
• Appropriately screen and background check drivers
• Implement safety design changes to the Lyft app
• Respond to complaints and feedback about sexual misconduct

The MDL is not a Lyft class action lawsuit. Class actions and MDLs are both mass torts that combine cases for efficiency, but they operate differently. One of the primary distinctions is that cases in a class action receive a single judgment, while claims in an MDL receive separate rulings.

Challenges in Lyft sexual assault cases 

Sexual assault cases against rideshare platforms like Lyft and Uber can present unique challenges. 

First, proving that Lyft is liable for the assault can be difficult. Rideshare apps consider their drivers independent contractors, not employees, so you may not be able to hold Lyft vicariously liable the same way you might with a taxi cab company or local transportation service., You must prove that the company itself acted negligently in protecting your safety and is, therefore, directly responsible for what happened. 

Second, there may be obstacles to evidence collection. Lyft may not cooperate in turning over information in its possession. And most of these types of assaults take place in vehicles owned by the accused Lyft drivers. 

Third, the statute of limitations could be yet another barrier. If it has expired, the court will likely bar (not allow) your suit.
