National Landmark Verdict: California couple wins case against pelvic mesh manufacturer

On July 23, 2012, a jury awarded a Bakersfield, Calif., couple $5.5 million in a case against C.R. Bard Medical, the manufacturer of the Avaulta Mesh pelvic mesh implant. The plaintiffs alleged that C.R. Bard knew that the mesh was unsafe but decided to continue selling it.

"The hardest part, I will tell you, through this whole thing, is having to keep quiet, watching women still get hurt. But, I was legally not able to get out there …. So, when I got that verdict it was like 'Thank you God.' Now we can do something," said plaintiff Christine Scott in an article published by KGET.com

Following this plaintiffs' verdict, legal and medical professionals are now taking note. The Securities and Exchange Commission indicates that approximately 47,000 women have received pelvic mesh implants, and more than 600 pelvic mesh lawsuits have been filed against manufacturers.

Between 2005 and 2010, nearly 4,000 injuries were reported to the FDA in connection with a transvaginal/pelvic mesh device.
